Terms of Use
The rules for using penaltybluff.com and playing Penalty Bluff in your browser.
These Terms of Use ("Terms") govern your use of penaltybluff.com and of the browser version of the Penalty Bluff game at penaltybluff.com/play/ (together, "the site" and "the game"), provided by Artem Podrushniak, an independent developer in Indonesia ("we", "us", "our").
1. Acceptance of the Terms
By using the site or playing the game, you agree to these Terms. How we handle data is described in our Privacy Policy. If you do not agree, please do not use the site.
2. Who can use the site
Penalty Bluff is a general-audience game and is not directed at children under 13 (or the equivalent age set by the law where you live). Younger children may use it only with the consent and under the supervision of a parent or guardian.
3. Your licence to play
The game is free. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the site and play the game in a web browser for your own personal, non-commercial purposes, in line with these Terms.
You may record, stream and share videos and screenshots of your matches, including on social networks and video platforms, without asking us first. Please do not present them as official Penalty Bluff material or suggest that we endorse you.
4. Fair play and acceptable use
You agree not to:
- cheat: modify, decompile or reverse-engineer the game, automate your picks with scripts or bots, or exploit bugs to win matches or collect coins, except where the law expressly permits it;
- tamper with online play: send forged or altered messages to the game server, try to learn an opponent's pick before the reveal, or interfere with the state of a match on the server;
- abuse online play: flood the server, try to get around its request limits, try room codes at random to enter rooms that were not shared with you, or deliberately spoil other players' matches;
- use a player name that is offensive, hateful, sexual, threatening, harassing or discriminatory, or that impersonates another person, a real player, a club or an organisation — in online play, your name is shown to your opponent;
- generate artificial ad views or clicks, for example with bots or by asking others to click;
- copy, re-host, frame or embed the game or the site's pages on another website or in an app, or remove our notices from them;
- overload the site with automated requests or collect its content by automated means beyond what ordinary search engines do;
- use the site in a way that breaks the law or infringes the rights of others.
If we reasonably suspect a breach of this section, we may close a room, end a match or restrict or block your access to online play, without prior notice.
5. Online play
- The game server decides every online kick from the two picks it receives. If your time to pick runs out, the server picks a random zone for you. A player who stops picking or disconnects for good can lose the match by forfeit.
- A room is deleted an hour after the last activity in it, and its invite link then stops working.
- We cannot promise that a random opponent will be available. If you are left waiting, you can choose to play a bot instead; a bot is always labelled as a bot.
- There is no chat. Your opponent sees only your name (against a random opponent, the name the server gave you), your picks once they are revealed, the score and whether you are connected.
6. Coins and Locker room items
- Coins and the items you get for them in the Locker room are part of the game. They are earned only by playing and buy only looks for the keeper, the shooter and the ball; nothing that affects a kick can be bought.
- They have no monetary value. In the browser version they cannot be bought with real money, and they cannot be sold, transferred, or exchanged for money, prizes or anything outside the game. They are part of your licence to play, not your property.
- They are stored only in your browser, together with the rest of your progress. Clearing the site data, playing in a private window or switching to another browser or device can lose them, and we cannot restore them, because we never have a copy.
- We may change rewards, prices and items, for example to keep the game balanced.
7. Ads
The site and the game show or may show ads provided by Google AdSense. Ads come from third parties: we do not control them and are not responsible for the products, services or websites they promote. How ads use cookies, and the choices you have, are explained in the Privacy Policy.
8. Availability and changes to the game
We provide the site free of charge and cannot promise that it will always be available. It may be interrupted for maintenance, faults or network problems, and online play may be switched off for a while. We may change the game at any time — its rules, modes, rivals, rewards and items — and we may limit or discontinue the site or the game, in whole or in part, including for security, technical or legal reasons. Phone versions of the game, once released, may come with their own terms and the terms of the app store you get them from.
9. Intellectual property
- The game and the site — the Penalty Bluff name and logo, the artwork, characters, sounds, texts and code — belong to us or are used under licence, and are protected by intellectual property laws. Apart from the licence in section 3, these Terms give you no rights in them.
- The fonts Oswald and Rubik are used under the SIL Open Font License, version 1.1; their licence texts are included with the site and the game. The game is built with Flutter and other open-source components, which are used under their own licences.
- Penalty Bluff contains no real clubs, crests, players, leagues or competitions. The rivals, names and kits in the game are fictional, and any resemblance to real teams or people is coincidental. Penalty Bluff is not affiliated with, endorsed by or connected to any football club, league, federation or player.
10. Feedback
If you send us ideas or suggestions, we may use them to improve the game without any obligation to you.
11. Third-party services and links
The site relies on third-party services, such as hosting and advertising, and may link to other websites. Their own terms and policies apply to them, and we are not responsible for their content.
12. Disclaimer of warranties
The site and the game are provided "as is" and "as available". To the maximum extent permitted by law, we do not warrant that they will work without interruption or errors, that your progress will be preserved, or that an online opponent will be found.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for the loss of progress, coins, items or data, arising from the use of, or inability to use, the site or the game. Nothing in these Terms limits liability that cannot be limited by law, or the rights you have as a consumer under the mandatory law of your country.
14. Ending your use
You can stop using the site at any time; clearing its data from your browser removes everything the game kept there. We may suspend or end your access to online play if you break these Terms. Sections 6 and 9 to 15 continue to apply after that.
15. Governing law
These Terms are governed by applicable law, subject to mandatory consumer protection rules in the user's jurisdiction. If any part of these Terms is found unenforceable, the rest remains in force.
16. Changes to these Terms
We may update these Terms from time to time. We publish each new version on this page; it takes effect on the date shown at the top. If you keep using the site after that date, the updated Terms apply.
